General Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following terms are defined as:

  • Cooling-off period: the period within which a consumer can exercise their right to withdraw;

  • Consumer: a natural person who is not acting for purposes related to their trade, business, craft or profession;

  • Day: calendar day;

  • Ongoing agreement: a contract concluded remotely for a series of products and/or services, where the delivery and/or obligation to supply is spread over time;

  • Durable medium: any tool that enables the consumer or trader to store information directed to them personally, in a way that allows future consultation and unaltered reproduction of the stored information;

  • Right of withdrawal: the consumer’s ability to withdraw from the remote agreement within the cooling-off period;

  • Trader: the natural or legal person offering products and/or services to consumers remotely;

  • Remote agreement: an agreement entered into exclusively through one or more means of remote communication within the framework of a system organised for remote sale of products and/or services;

  • Means of remote communication: tools that can be used to conclude a contract without the consumer and trader being together in the same place;

  • General Terms and Conditions: these general terms and conditions of the trader.

Article 3 – Scope

These General Terms and Conditions apply to every offer from the trader and to every remote agreement entered into between the trader and the consumer. Before the contract is concluded remotely, the consumer will be provided with these Terms and Conditions. If this is not reasonably possible, the trader will indicate how the Terms and Conditions can be reviewed electronically.

Article 4 – The Offer

If an offer is subject to a limited duration or special conditions, this will be clearly stated. Offers are non-binding and subject to change.
Each offer includes a complete and accurate description of the products and/or services offered. Descriptions are sufficiently detailed to allow proper assessment. Images used are intended to be a true representation, but colour variations may occur depending on screen settings.
Clear information will be provided on:

  • Price (excluding duties and import GST);

  • Any additional charges that may apply;

  • Shipping costs;

  • How the agreement is formed and the steps involved;

  • Whether the right of withdrawal applies;

  • Accepted payment methods, delivery options, and execution of the contract;

  • Validity of the offer and pricing;

  • Language options for the agreement;

  • Information about the trader’s conduct codes, where applicable;

  • Whether the contract will be stored and how the consumer may access it.

Please note: When goods are shipped to Australia, the recipient may be liable for import duties, customs fees, and GST. These are not charged by LUJIV and are the sole responsibility of the recipient. The applicable postal or courier company will collect these fees upon import.

Article 5 – Agreement Formation

The agreement is concluded when the consumer accepts the offer and complies with the stated conditions.
If the consumer accepts the offer electronically, LUJIV will confirm receipt of the order promptly. Until confirmation is sent, the consumer may cancel the order.
LUJIV implements appropriate technical and organisational measures for secure electronic transactions.
In accordance with legal obligations, LUJIV may assess the consumer’s ability to fulfil their payment obligations and may refuse orders on reasonable grounds.
Upon conclusion of the agreement, LUJIV will send the following information to the consumer via email or another durable medium:

  • Contact address for complaints;

  • Conditions under which the right of withdrawal may be exercised;

  • Information on warranties and after-sales service;

  • A summary of these Terms and Conditions (if not already provided);

  • Cancellation policies, if the agreement has a duration of more than one year or is indefinite.

All agreements are subject to product availability.

Article 6 – Right of Withdrawal (Returns)

Consumers have the right to withdraw from a product purchase within 14 days of receiving the item, without stating a reason.
During this period, the product may only be handled as necessary to determine its suitability.
Returns must include all original accessories, packaging, and documentation, in original condition.
To exercise the right of withdrawal, the consumer must notify LUJIV by email within 14 days of receipt. The item must be returned within a further 14 days.
Return shipping costs are borne by the consumer. Proof of return (e.g. tracking receipt) must be provided.
If the consumer does not notify LUJIV within the specified periods, the purchase becomes final.

Article 7 – Refunds

If the right of withdrawal is exercised, LUJIV will refund the purchase amount as soon as possible, no later than 14 days after receipt of the returned goods or proof of shipment.

Article 8 – Exclusions to the Right of Withdrawal

The right of withdrawal does not apply to products that:

  • Are made to the consumer’s specifications;

  • Are clearly personal in nature;

  • Cannot be returned due to hygiene or health reasons (e.g. pierced jewellery, worn underwear);

  • Deteriorate quickly or have a short shelf life;

  • Are digital downloads, opened software, or unsealed audio/video products;

  • Involve newspapers, magazines, or custom print items;

  • Are services that have already commenced with consumer consent.

Article 9 – Pricing

Prices remain valid during the stated offer period, unless influenced by changes in VAT or import duties.
Prices may vary for products tied to foreign currency or global market fluctuations.
In the case of printing or typographical errors, LUJIV is not obliged to honour incorrect pricing.
All prices are in AUD and exclude applicable import GST and duties for Australian orders.

Article 10 – Compliance and Warranty

Products are guaranteed to meet the description, functionality, and reasonable standards of quality.
If applicable, LUJIV honours the manufacturer’s warranty.
Issues must be reported in writing within 14 days of delivery. Items must be returned unused and in their original packaging.
Warranty is void if:

  • Products have been altered or repaired by the consumer or third parties;

  • The product was used contrary to instructions;

  • Damage results from external factors beyond LUJIV’s control.

Article 11 – Delivery and Fulfilment

Orders are processed with care and shipped to the address provided by the consumer.
Unless otherwise agreed, delivery will occur within 40 days.
Delays will be communicated promptly. If fulfilment is impossible, LUJIV will offer an alternative or refund.
Risk of damage or loss transfers to the consumer upon delivery.
If a replacement item is sent, the consumer retains the right to return it.

Article 12 – Ongoing Subscriptions (if applicable)

Consumers can cancel ongoing agreements at any time with one month’s notice.
Contracts may not be automatically renewed beyond their initial term unless agreed in advance.
Renewals will comply with fair notice periods and transparent terms.

Article 13 – Payment

Unless otherwise agreed, payments must be made during the ordering process.
The consumer has a duty to provide accurate and complete payment details. In case of incorrect information or suspected fraud, LUJIV reserves the right to cancel the order.
If a payment is reversed or fails after the order has been shipped, LUJIV may recover the outstanding amount through appropriate means.
Any legal costs or collection fees incurred due to late or failed payment will be passed on to the consumer.

Article 14 – Complaints Procedure

If the consumer has a complaint regarding a product or service, they must contact LUJIV via email within 14 days of delivery.
Complaints should include a clear description and any supporting photos or documentation.
LUJIV will respond within 5 business days with a proposed solution.
If a complaint cannot be resolved mutually, it may be escalated via mediation or other dispute resolution avenues in accordance with Australian Consumer Law.
Complaints do not suspend any payment obligations.

Article 15 – Disputes

These General Terms and Conditions are governed by the laws of The Netherlands, unless otherwise required under the Australian Consumer Law (ACL).
In case of a dispute, both parties will first attempt to resolve it amicably.
If resolution is not reached, the dispute may be referred to a competent court in accordance with international consumer law regulations.
For Australian consumers, statutory protections under the ACL continue to apply.

Article 16 – Additional or Deviating Provisions

Any additional terms or deviations from these General Terms and Conditions must be clearly communicated in writing and accepted by both parties.
In the event of conflict between these Terms and any additional agreements, the additional agreement prevails only where it improves consumer rights.

Article 17 – Final Provisions

  • LUJIV reserves the right to update these Terms and Conditions from time to time.

  • The most current version will always be available on our website.

  • Changes will not affect previously concluded agreements unless required by law.

  • If one or more provisions in these Terms are deemed invalid or unenforceable, the remaining provisions will remain in effect.

Article 18 – Force Majeure

LUJIV is not liable for any failure or delay in performance due to events outside its reasonable control, including but not limited to:

  • Acts of God;

  • Governmental restrictions or regulations;

  • Pandemics;

  • Strikes or other labour disturbances;

  • Shipping disruptions or customs delays;

  • Internet or telecommunications outages.

In such cases, LUJIV will inform the consumer as soon as possible. If the situation persists for more than 30 days, both parties may cancel the agreement without penalties.

Article 19 – Intellectual Property

All content on the LUJIV website, including images, texts, logos, and product descriptions, is the intellectual property of LUJIV or its licensors.
Use of this content without written permission is prohibited and may result in legal action.
